The following terms and conditions are upon which Plumbing NT (ABN: 48 155 906 362) and any person acting on its behalf and with its authority will provide plumbing and gas fitting services to any corporation, business or customer (“client”) that engages Plumbing NT to provide these services.
DEFINITIONS
“$0 call out fee” means that we do not charge you to arrive at your door, between business hours (8am to 5pm, Monday to Friday). A minimum time on site is charged per job attended to.
“Free quotes” include broad estimates only. Detailed plumbing consultancy services are available at an additional cost. This includes (but isn’t limited to) advice or proprietary knowledge that offers further assistance in reducing problems. A quote may be given and accepted by the ‘client’ verbally. All accepted quotes will be invoiced at the agreed rate, unless new rates are discussed and agreed upon. Quoted prices are only relevant if Plumbing NT have uninterrupted and free access to site. If Plumbing NT are required to leave and return due to access issues, parts or services supplied by other parties not being to standard (but not limited to), additional costs may apply.
“Limited lifetime labour guarantee” applies to only workmanship undertaken by Plumbing NT and not applicable on parts or materials. This is due to (but not limited to) the general wear and tear of materials being outside of Plumbing NT’ control once installed.
1. PLUMBING MAINTENANCE SERVICES FEES
We charge a $0 call out fee within business hours (8am to 5pm, Monday to Friday). There is also a fuel levy charged per job.
NT – A minimum of one hour is charged per job. After the initial hour, our rates are charged in 15 minute increments.
QLD – A minimum of half an hour is charged per job. After the initial half an hour, our rates are charged in 15 minute increments.
All works requested by the customer outside of regular trading hours (8am – 5pm, Monday to Friday & public holidays) will incur additional cost at rates to be advised and approved by the customer prior to proceeding with the works.
Plumbing NT reserves the right to charge a minimum fee for any (but not limited to) inspection services, advice or proprietary knowledge that assists the ‘clients’ in reducing a problem.
Due to Occupational Health and Safety reasons, Plumbing NT may require two or more tradespersons on site to align with and follow these requirements. Please note that works for both tradespersons will be charged. This includes, but is not limited to working on roofs, using our high powered jetter machine.
Quoted or estimated priced works are accepted by Plumbing NT in writing (of any form). Accepted quotes become a legally binding contract between Plumbing NT and the ‘client’, as per Government guidelines relating to consumers around quotes, estimates and contracts.
If the client agrees to proceed with works in excess of a quoted price of $2000, a 30% deposit may be required be paid to Plumbing NT prior to commencement of works. Plumbing NT will not refund the deposit.
Quoted prices are valid for 30 days. After this period quoted prices will need to be reviewed. If supplier prices have increased, this will then we rectified and amended in our quotes.
In the instance that works are diagnosed by others, Plumbing NT take no responsibility for incorrect diagnosis or damages caused.
In the event that Plumbing NT are ‘called back’ to a previously attended job due to repairs undertaken still contributing to a fault, fees will not apply for reattendance. In the event that we attend and the work undertaken by us is not at fault and a new issue is present, Plumbing NT reserve the right to charge additional fees.
2. MISSED APPOINTMENT CANCELLATION AND TIME POLICY
Plumbing NT have a missed appointment/cancellation policy to ensure that our plumbers are efficiently scheduled each day , so that they arrive promptly to each scheduled job. A minimum of at least 24 hours is required to change or cancel confirmed bookings or on-site quotations.
Standard hours missed appointments/cancellations where our team have not been advised incur a $121 inc GST fee.
We do understand that things happen unexpectedly and we will try our best to accommodate changes to appointments, where and when we can. This involves no additional cost.
3. PHOTOGRAPHS
Plumbing NT may take photos of the site and/or works for invoicing, reporting, proof of workmanship or liability purposes. These photographs may be used by Plumbing NT for promotional purposes.
4. PAYMENT OF INVOICES
Clients must pay full invoices within 7 days of receipt of invoice. If not paid in full within 7 days, Plumbing NT reserves the right to charge late payment fees. All materials remain the property of Plumbing NT until all outstanding balances are paid in full by the client.
Plumbing NT reserves the following rights in relation to the goods until all accounts owed by purchaser to Plumbing NT are paid in full:
i) legal ownership of the goods and services provided
ii) to enter the purchaser’s premises (or the premise of an associated company or agent where the goods are located) without liability or trespass to retake possessions of the goods
iii) Plumbing NT will not be liable for any resulting damage associated with retaining possession of goods and services
iv) Costs to remove materials in ownership of Plumbing NT will be charged to the customer
v) Any associated debt collection costs incurred to recover debt and repossess goods and services, will be charged to the client
5. ACCESS
It is the client’s responsibility to provide appropriate and safe access to the area of works. Plumbing NT takes as much care as possible, however, we will not be held responsible for (but not limited to) cracking foundations and correcting unforeseen problems of any structure, service or earth including existing plumbing services. Plumbing NT will provide a variation to price to make safe or correct any unforeseen circumstances at the client’s request.
6. DRAIN CLEANING
The client shall not hold Plumbing NT responsible, and shall be solely responsible for any damage or expense incurred to remove, restore, repair or replace it’s premises and/or as well as the damaged equipment of Plumbing NT, or if any tool or pieces of equipment of Plumbing NT becomes stuck in a drainage line.
If there is a sewerage spill, including one deemed hazardous, the cost of clean-up is the sole responsibility of the client.
Removal of tree root growth or blockage alone will not ensure that similar problems will not recur and as such carries no guarantee unless otherwise stated herein.
7. UNFORSEEN CIRCUMSTANCES
If conditions and/or circumstances are encountered at the job site which are;
i) concerned physical conditions
ii) unknown physical condition of an unusual nature. which differ materially from that which is visually ascertained, client agrees to accept responsibility for those circumstances outside the control of Plumbing NT and further agrees to pay for any labour or materials, including repair to damaged equipment of Plumbing NT and other plumbing caused by such conditions/circumstances.
It is in the intent of this provision to make client fully responsible for all;
i) unforeseen and concealed conditions
ii) for that which Plumbing NT can not control
Accordingly, the client further agrees to hold Plumbing NT harmless and shall protect and defend Plumbing NT and all its employees from and against claims, damages, losses and expenses including but not limited to solicitor fees, consequential damages, arising out of as a result from the performance of Plumbing NT work involving, affecting, or relating to such unforeseen or concealed conditions regardless of whether such damages are caused in part by Plumbing NT, except for Plumbing NT sole negligence.
Plumbing NT will not be held responsible for any resulting damages as a result of fulfilling their duties in their entirety, including but not limited to, removal of structures, gyprock, walls for access, removal of garden beds, cracking of ceiling/roof spaces as a result of not being secure, bench, countertop, paving and concrete for access and working area damages as a result of required chemicals (blocked drains etc).
8. ASBESTOS OR OTHER HAZARDOUS MATERIAL REMEDIATION WORK
Plumbing NT has no information whatsoever with respect to asbestos or other hazardous materials or substances in any portion of the customer’s property and has conducted any investigation in connection here within. Plumbing NT does not perform asbestos or other hazardous material or substance removal and shall have no responsibility whatsoever for any such removal. The client expressly releases and shall hold Plumbing NT harmless from any liability whatsoever and for all claims arising out if its presence, release, remediation or removal and for any costs, losses or damages the client may suffer or sustain if it is found to exist on the customer’s property.
9. CALL BACK TO SITE
Plumbing NT charge another standard fee for attending site if the reason for re-attendance was not in the scope of Plumbing NT works. This may relate (but is not limited to) circumstances in which the client has advised they will be providing materials/coordinate a dependent service, but neither the materials, dependent service or site isn’t up to standard for the plumber to start works.
10. PUBLIC LIABILITY AND LICENSING
Plumbing NT agrees to keep all insurances including public liability up to date and valid, along with all contractor licenses.
The client protects and holds harmless the contractor and Plumbing NT against any loss, threatened or otherwise, or expense by reason of the liability of the contractor arising out of any claim for damaged for personal injury, or property damage to either the site or to the moveable property on the site.
11. MAILING LIST
By engaging Plumbing NT or submitting details in one of our online forms, you are accepting that you will automatically be signed up to our mailing list.
